Narrative

     On 22 October 1805, Joseph Daughtry filed a Billl of Complaint against Joel Daughtry, Josiah Daughtry, Elizabeth Daughtry, and Nancy Daughtry. A second bill of complaint in April 1806 stated that in 1795 Joseph Daughtry coveyed land to Samuel Daughtry his brother to secure a debt. Land consisted of 200 acres on the north side of Little Swamp on a prong of the Tyancokey River. The said Samuel died without settling the said security and Joseph brought suit against the four infants of the deceased.1

     Josiah probably died before 1821.2

Narrative

     The will of Josiah has not been located but there are deeds of disposition of the 200 acres he inherited from his father Samuel. A third of the land went to each of siblings Nancy, Joel, and Elizabeth. Neither Mary wife of Samuel or Henry son of Mary were inherited any of the land. This would seem to indicate that Josiah was not a son of Mary and was probably a son of Samuel by a previous wife. Also it would seem to indicated that Henry was not a son of Samuel and thus did not share in the disposition of the land inherited by Josiah from his father Samuel. The deeds of disposition of Joshiah's land provided in an email from Joani Taylor2 are as follows:

Co. for $400, a tract of land beginning at a prong of Tyan Cokey Swamp at a white oak a corner then north 144 poles to a pine another corner then east along the line of John Battles now Joel Battles to a pine a corner tree then south by a line of marked trees to a pine in Hooks Branch then along the said Branch to the said swamp then up the various courses of said swamp to the first station, containing 163 acres and, 66 2/3 acres on the north side of said Cokey Swamp joining the said above tract on the upper side which accrued to me by the death of my brother, Josiah Daughtry out of 200 acres where Elizabeth Daughtry formerly lived it being a part that acreed to me as heir and claimer of my father, Samuel Daughtery, decd, signed Joel H. Davidson, on 11 March 1897.1 He married fourth Cordelia Wilson on 18 January 1898.6,7 John died on 2 April 1928 at age 82.1 He was interred at Daughtrey Cemetery at Dade Co., Missouri.1
